Are you up to date with the new substances that ECHA has added to the Candidate List?
The latest updates to this list were carried out from January 23 to June 27, 2024, adding 6 new substances due to their hazardous properties. This affects all companies in the chemical sector that work with products containing these substances, which are required to report them appropriately in accordance with current regulations.
We detail exactly which 6 SVHC substances have been added and how you can properly reflect them in your Safety Data Sheets.
What is the Candidate List?
The REACH Regulation (European Regulation concerning the Registration, Evaluation, Authorization, and Restriction of Chemicals) requires companies to identify and manage the risks associated with the substances they manufacture and market in the EU. Member States or ECHA may propose that a substance be identified as SVHC (Substances of Very High Concern) by preparing a dossier in accordance with the requirements set out in Annex XV of REACH.
SVHC substances are included in the Candidate List for further evaluation. These substances should be replaced by others that do not carry these risks and are viable from a production and economic standpoint.
Being on the Candidate List carries obligations for the industry when included as such in mixtures or articles.
This means that any supplier of articles containing a substance from the Candidate List above a concentration of 0.1% (weight/weight) is obligated to inform customers and consumers throughout the supply chain so they can use them safely. Additionally, importers and producers of articles containing these substances have six months from the date of inclusion in the Candidate List to notify ECHA if their article contains any of the listed substances.
Suppliers of Candidate List substances, provided as such or in mixtures, must provide their customers with a Safety Data Sheet containing this information.
These are the new SVHC substances included in the Candidate List:
Bis(α,α-dimethylbenzyl) peroxide; CAS: 80-43-3 EC: 201-279-3
Oligomerisation and alkylation reaction products of 2-phenylpropene and phenol; CAS: - EC: 700-960-7
Phenol, methylstyrenated; CAS: 68512-30-1 EC: 270-966-8
Bumetrizole (UV-326); CAS: 3896-11-5 EC: 223-445-4
2-(dimethylamino)-2-[4-(4-methylphenyl)methyl]-1-[4-(morpholin-4-yl)phenyl]butan-1-one; CAS: 119344-86-4 EC: 438-340-0
2-(2H-benzotriazol-2-yl)-4-(1,1,3,3-tetramethylbutyl)phenol (UV-329); CAS: 3147-75-9 EC: 221-573-5
These SVHC substances are used, for example, in flame retardants, paints and coatings, inks and toners, coating products, plasticizers, and in the manufacture of pulp and paper.
As noted, the Candidate List contains substances that pose particular concern (Substances of Very High Concern - SVHC) and currently includes 241 chemical substances that can harm people or the environment.
Once a substance moves from the Candidate List to the Authorization List, its use will be prohibited unless companies obtain authorization from the European Commission to continue using it.
